PUBLIC NOTICE

Federal law 40 CFR 403 requires public notification of any industrial user that is in Significant Non-Compliance (SNC) as defined by the Town of Selbyville Code, Section 146-83. During the annual assessment of the fifteen-month period starting on October 1, 2010 and ending on December 31, 2011, the pre-treated wastewater from Mountaire Farms, Inc. was in SNC. Mountaire Farms, Inc. exceeded the 66% SNC Total Kjeldahl Nitrogen lbs/day monthly average limit for the six month period ending March 31, 2011 and is defined as “chronic violations.” They also exceeded the 33% Technical Review Criteria for BOD lbs/day monthly average limit for the same period.
Mountaire Farms, Inc. exceeded the 33% Technical Review Criteria for TKN lbs/day monthly average limit for the six month period ending June 30, 2011.
